You see, the CPS therapists are paid by the County and you are to see "their" therapists who are paid to write false reports. If they can't find a mental condition they will send you to several doctors, like in my case. Jenny was threatened.Social Worker Louise Tobin flew to Iowa days before she was to return to California. She made arrangements for Jenny to be watched 24 hours a day. Jenny was forced to work at a Daycare center so she could be "babysat" while her father was at work. Dad disconnected his phone so Jenny had no way to call for help. She would sneak me messages when her Dad was sleeping. CPS is one sick agency. THEY ARE EVIL.

They've threatened her with Juvenile Hall, put her in "negative therapy", coerced her with "In & Out Burgers"....in attempts to stop her from contacting me. They even took her to the hospital to try to "pump her stomache". CPS tells children up lies, they try to turn children against their parents (facism)by alienating them, they manipulate children and and try to give them false memories. This is CHILD ABUSE!!!

What's wrong with CPS???? My daughter was never abused. The ONLY person who has EVER abused my daughter is CPS! My daughter is now cutting on herself because she wants to come home. She has NEVER cut on herself before CPS entered her life. She started doing this after they told her they were going to take her away from me.

They had no right to kidnap Jenny from school. There was no warrant and no placement agreement. CPS falsified the documents and traumatized my daughter.....all for MONEY!!

The US/Blair Government is abusing extradition laws, I'm afraid.

On 31 March, David Blunkett, UK Home Secretary, signed an Extradition Treaty on behalf of the UK with his United States counterpart, Attorney General Tom Ashcroft, ostensibly bringing the US into line with procedures between European countries. The UK parliament was not consulted at all and the text was not public available until the end of May. The only justification given for the delay was "administrative reasons", though these did not hold-up scrutiny by the US senate, which began almost immediately.

The UK-US Treaty has three main effects:

- (1) it removes the requirement on the US to provide prima facie evidence when requesting the extradition of people from the UK but maintains the requirement on the UK to satisfy the "probable cause" requirement in the US when seeking the extradition of US nationals;

- (2) it removes or restricts key protections currently open to suspects and defendants;

- (3) it implements the EU-US Treaty on extradition, signed in Washington on 25 June 2003, but far exceeds the provisions in this agreement.

An analysis of the new UK-US Treaty - which will replace the 1972 UK-US Treaty - follows below, together with a number of relevant cases and issues that raise serious concern about the new agreement (and those between the EU and US).

"Under the new treaty, the allegations of the US government will be enough to secure the extradition of people from the UK. However, if the UK wants to extradite someone from the US, evidence to the standard of a "reasonable" demonstration of guilt will still be required.

No other EU countries would accept this US demand, either politically or constitutionally. Yet the UK government not only acquiesced, but did so taking advantage of arcane legislative powers to see the treaty signed and implemented without any parliamentary debate or scrutiny.

Guantanamo Bay, the failed extradition of Lofti Raissi and US contempt for the International Criminal Court make this decision to remove relevant UK safeguards all the more alarming"

Evidence requirements in the new UK-US extradition treaty

Article 8 of the UK-US Treaty sets out the new extradition procedures between the two countries [1]. As with the old treaty [2], the offences in question must satisfy 'dual criminality' and be punishable in both states by a minimum custodial sentence of one year or more. The crucial 'update' is that under the old treaty (Article IX), the requesting state had to provide evidence:

"sufficient according to the law of the requested Party… to justify the committal for trial"

A reasonable standard and not especially high (essentially the same standard required at the committal stage in domestic criminal proceedings). Under the new treaty (art. 8, para. 2(b)) the state seeking extradition must provide:

"a statement of the facts of the offense(s)" [sic]

The Home Office press release announcing the treaty (to parliament and public alike) stated that a 'detailed statement of the facts of the case' would be required [3]. In the event it hardly matters, "facts" here do not mean evidence but refer instead to allegations. By way of example, the equivalent requirement in the European Arrest Warrant [4] is a:

"Description of the circumstances in which the offence(s) was (were) committed, including the time place and degree of participation in the offence(s) by the requested person"

In practise this may only be a few sentences. Critically, there is an additional requirement on the UK only to provide (art. 8, para. 3(c)):

"for requests to the United States, such information as would provide a reasonable basis to believe that the person sought committed the offense" [sic]

In effect, the evidence requirement on the US has been dropped altogether while the UK must still provide evidence to the standard of a 'reasonable' demonstration of guilt. As Justice note in a recent briefing on the treaty [5], the reasoning behind this lack of reciprocity is:

"that the United States has a constitutional protection which prevents it from extraditing a US citizen purely on the say-so of a foreign government. As the UK does not have such a constitutional protection, the UK is at liberty to forego this important safeguard in the interests of speeding up extraditions to the US"

THE CALIFORNIA FAIR POLITICAL PRACTICES & POLITICAL REFORM ACT (SECTION 85701), LAUNDERED CONTRIBUTIONS
& LIABILITY FOR VIOLIATION; CRIMINAL AND CIVIL (SECTION 91015), AND THE PATRIOT ACT 2001

Money laundering is the practice of engaging in financial transactions in order to conceal the identity, source, and/or destination of money, and is a main operation of the underground economy.

In the past, the term "money laundering" was applied only to financial transactions related to organized crime. Today its definition is often expanded by government regulators (such as the United States Office of the Comptroller of the Currency) to encompass any financial transaction which generates an asset or a value as the result of an illegal act, which may involve actions such as tax evasion or false accounting. As a result, the illegal activity of money laundering is now recognized as potentially practiced by individuals, small and large businesses, corrupt officials, members of organized crime (such as drug dealers or the Mafia), and even corrupt states, through a complex network of shell companies and trusts based in offshore tax havens. A few examples of money laundering are smurfing or kiting.

The increasing complexity of financial crime, the increasing recognized value of so-called "financial intelligence" (FININT) in combating transnational crime and terrorism, and the speculated impact of capital extracted from the legitimate economy has led to an increased prominence of money laundering in political, economic, and legal debate.

Process

Money laundering is often described as occurring in three stages: Placement, layering, and integration.[3]

1. Placement: refers to the initial point of entry for funds derived from criminal activities.
2. Layering: refers to the creation of complex networks of transactions which attempt to obscure the link between the initial entry point, and the end of the laundering cycle.
3. Integration: refers to the return of funds to the legitimate economy for later extraction.

However, The Anti Money Laundering Network recommends the terms

1. Hide: to reflect the fact that cash is often introduced to the economy via commercial concerns which may knowingly or not knowingly be part of the laundering scheme, and it is these which ultimately prove to be the interface between the criminal and the financial sector
2. Move: clearly explains that the money launderer uses transfers, sales and purchase of assets, and changes the shape and size of the lump of money so as to obfuscate the trail between money and crime or money and criminal.
3. Invest: the criminal spends the money: he/she may invest it in assets, or in his/her lifestyle.

Examples

If a person is making thousands of dollars in small change a week from a business (not unusual for a store owner) and wishes to deposit that money in a bank, it cannot be done without possibly drawing suspicion. In the United States, for example, cash transactions and deposits of more than a certain dollar amount are required to be reported as "significant cash transactions" to the Financial Crimes Enforcement Network (FinCEN), along with any other suspicious financial activity which is identified as "suspicious activity reports." In other jurisdictions suspicion-based requirements are placed on financial services employees and firms to report suspicious activity to the authorities. Methods to conceal the source are therefore required.

Irregular funding

One method of keeping this small change private would be for an individual to give money to an intermediary who is already legitimately taking in large amounts of cash. The intermediary would then deposit that money into an account, take a premium, and write a check to the individual. Thus, the individual draws no attention to himself, and can deposit his check into a bank account without drawing suspicion. This works well for one-off transactions, but if it occurs on a regular basis then the check deposits themselves will form a paper trail and could raise suspicion.

Captive business

Another method involves establishing a business whose cash inflow cannot be monitored, and funneling the small change into this business and paying taxes on it. All bank employees however are trained to be constantly on the lookout for any transactions which appear to be an attempt to get around the currency reporting requirements. Such shell companies should deal directly with the public, perform some service-related activity as opposed to providing physical goods, and reasonably accept cash as a matter of business. Dealing directly with the public ensures plausible anonymity of source. An example of a legitimate business displaying plausible anonymity of source would be a hairstylist. Since it would be unreasonable for them to keep track of the identity of their customers, a record of their transaction amounts must be ostensibly accepted as prima facie evidence of actual financial activity. Service-related businesses have the advantage of anonymity of resources. A business that sells computers has to account for where it actually got the computers, whereas a plumbing company merely has to account for labor, which can be falsified. Reasonably accepting cash means the business must regularly perform services that total less than $500 on average, since above that amount most people pay with a check, credit card, or other traceable payment method. The company should actually function on a legitimate level. In the plumbing company example, it is perfectly reasonable for a lot of the business to involve only labour (no parts), and for some business to be paid for in cash, but it is unreasonable for all of their business to involve no parts and only cash payment. Therefore the legitimate business will generate a legitimate level of parts usage, as well as enough traceable transactions to mask the illegitimate ones.

****Corrupt politicians and lobbyists also launder money by setting up personal non-profits to move money between trusted organizations, so that donations from inappropriate sources may be illegally used for personal gain.

Legal considerations

Many jurisdictions adopt a list of specific predicate crimes for money laundering prosecutions as a "self launderer" (the UK has an "all-crimes" regime). In addition, AML/CFT laws typically have other offences such as "tipping off," "willful blindness," not reporting suspicious activity, and conscious facilitation of a money launderer/terrorist financier to move his/her monies.

American legislation

The Bank Secrecy Act of 1970 requires banks to report cash transactions of $10,000.01 or more. The Money Laundering Control Act of 1986 further defined money laundering as a federal crime. The USA PATRIOT Act of 2001 expanded the scope of prior laws to more types of financial institutions, added a focus on terrorist financing, and specified that financial institutions take specific actions to "know your customer" (KYC).

In the United States, Federal law provides (in part): "Whoever . . . knowing[ly] conducts or attempts to conduct . . . a financial transaction which in fact involves the proceeds of specified unlawful activity . . . with the intent to promote the carrying on of specified unlawful activity . . . shall be sentenced to a fine of not more than $500,000 or twice the value of the property involved in the transaction, whichever is greater, or imprisonment for not more than twenty years, or both."[5]

While money laundering typically involves the flow of "dirty money" (criminal proceeds) into a "clean" bank account or negotiable instrument, terrorist financing frequently involves the reverse flow: apparently clean funds converted to "dirty" purposes. A hawala may launder drug proceeds and help fund a terrorist, netting the incoming and outgoing funds with only occasional small net settlement transactions.

WHAT THIS MEANS:

THERE IS CURRENTLY NO PENALTY UNDER SECTION 91015 FOR THOSE ELECTED OFFICIALS WHO SET UP CHARITIES OR NON PROFIT ORGANIZATIONS TO THOSE THEY INFLUENCE. THIS IS WHY WE HAVE SO MUCH CORRUPTION ON BOTH THE JUDICIAL AND LEGISLATIVE LEVELS. SINCE 1996 208 HAS REPEALED PROP 34. IN MY OPINION I BELIEVE THAT SOME OF THESE FUNDS ARE BEING MISAPPROPIATED FOR SOME POLITICIANS HAVE NON PROFITS SET UP FOR CHILDREN. IT SEEMS THIS WOULD BE A DIRECT CONFLICT OF INTEREST WITHIN THE SEPARATION OF STATE.

The most natural bond is between a parent and child. It is the
building block of our communities and our world. Today that bond is
being torn apart, and at the hand of a system out of control.

With the new Adoption & Safe Families Act (ASFA) law, Child Protective
Services (CPS) agencies and their affiliated "non-profit" adoption
agencies, are generously rewarded for adopting out your children whether
you are innocent or not.

In 1974, Walter Mondale promoted the Child Abuse and Prevention Act
which began feeding massive amounts of federal funding to states to set
up programs to combat child abuse and neglect. Mondale expressed
concerns that the legislation could be misused, leading states to create
a "business" in marketing our children.

In 1997, President Clinton passed ASFA to help abused and neglected
children who languished in foster care. In a press release from the U.S.
Department & Human Services dated November 24, 1999, Clinton's
initiative was said to double the number of children in foster care by
year 2002. The drive of Clinton's initiative is the offering of cash
"bonuses" to states for every child adopted out of foster care.

The time allowed for parents to retrieve children from the system has
created a tool to terminate parents' rights. They hold our children long
enough so parents miss the deadline, and even hold babies long enough to
claim that the bond is between children and their biological parents is
broken.

In a recent article titled "Santa Clara County Named in $400 million
False Claims Damages Suit over DFCS/CPS Fraud" (see www.reliableanswers.
com), it was discovered that the agency was collecting federal dollars
for children who did not even exist. Psychiatrists were also used to
assist these agencies in attaining federal funds.

Dr. Shirley Moore, the National Director of Legislative Affairs for the
American Family Rights Association (AFRA), helped to investigate 75,000
CPS cases in Los Angeles, California. It resulted in 30,000 families
being reunited due to conflicts of interest.

Dr. Moore said the biggest problem is the fact that most people are
unaware. Anyone with beautiful children should be on guard. Abuse has
taken on a new meaning today because children are viewed as a commodity
in the system. Something is seriously wrong.

The system has been designed so that everyone involved in the system
collaborates to attain the same goal--to get the child no matter what.
Why? The Almighty Dollar.

According to the Child Protective Parent Association (CPPA), for every
child Department of Social Services (DSS) adopts out, there is a bonus
of $4,000 to $6,000. "But that is just the starting figure in a complex
mathematical formula in which each bonus is multiplied by the percentage
that the state has managed to exceed its baseline adoption number,"
writes Karen Anderson of CPPA.

A report from a private think tank, the National Center for Policy
Analysis, reads: "The way the federal government reimburses States
rewards a growth in the size of the program instead of the effective
care of children."

The United States spends over $12 billion a year on "child protection",
one of the biggest businesses in our country. The money goes to tens of
thousands of state employees and to supportive professionals such as
lawyers, court personnel, court investigators, evaluators, guardians,
judges, and also to contracted vendors through DSS such as counselors,
therapists, residential facilities, foster parents, adoptive parents,
Big Brothers/Big Sisters, YMCA, etc.

The tearing apart of parent and child is worse than being lined up and
shot by Hitler's regime--You are left to live with a huge hole in your
heart. Not to mention the fury that this kind of violence perpetuates.

Start your research on the internet using the following: "CPPA what we
are about" for more information on how the system operates. See why we
have been unable to even get a response from our legislators. Perhaps
they have forgotten who funds their paychecks.

The keys are awareness and action. Get informed and do something about
the corruption in our government!

A recent study has found that 12-18 months after leaving foster care:

30% of the nation’s homeless are former foster children.
27% of the males and 10% of the females had been incarcerated
33% were receiving public assistance
37% had not finished high school
2% receive a college degree
50% were unemployed

Children in foster care are three to six times more likely than children
not in care to have emotional, behavioral and developmental problems,
including conduct disorders, depression, difficulties in school and
impaired social relationships. Some experts estimate that about 30% of
the children in care have marked or severe emotional problems. Various
studies have indicated that children and young people in foster care
tend to have limited education and job skills, perform poorly in school
compared to children who are not in foster care, lag behind in their
education by at least one year, and have lower educational attainment

Gov. Arnold Schwarzenegger strengthened the rights of California's 80,000 children in foster care on Monday, signing a law that ensures greater opportunities for youths to be present in court hearings deciding the course of their lives - from where they will live to how often, if ever, they will see their families.

The measure was introduced by Assemblyman Dave Jones, a Democrat from Sacramento, to address a major flaw in California's juvenile dependency courts throughout the state: Hearings routinely occur without the children whose lives are at stake. Their absence was one key problem highlighted in the February series in the Mercury News, "Broken Families, Broken Courts," that revealed deep dysfunction in the state dependency system, the largest in the nation.

A commission appointed by Chief Justice Ronald George later reiterated the problem.

The new law, which takes effect Jan. 1, calls for judicial officers to postpone hearings for children at least 10 years old if they have not been given notice and the chance to attend; while the law already called for children to be notified of hearings, it made no provision if the law was ignored.

In a letter released to members of the California State Assembly who had voted unanimously for the bill, the governor said he "wholeheartedly" supports the goal of providing foster children with greater access to hearings. "I am signing this bill because the foster children of this state deserve to have a role

in their futures," Schwarzenegger said.

Governor's rebuke

But he also sent a rebuke to local decision makers - the judges, lawyers and social workers who oversee such weighty matters as whether children will ever see their parents again, following allegations of abuse or neglect. Outside of Los Angeles, where the participation of children is an ingrained part of the local court culture, foster youths are routinely absent from hearings in their cases, the Mercury News investigation determined.

Judges up and down the state revealed in interviews that they are unable to make the best decisions for children in foster care when they cannot see them, hear from them, and attach a name with a file, regardless of the age of the child.

Schwarzenegger questioned "why the courts have not made such access a greater priority when it is allowed under current law. More likely than not the reason is lack of resources and overburdened court schedules, which this bill fails to address."

He also cautioned that whatever costs the new law would incur, such as transportation expenses or social worker time, would have to be borne under existing budgets, in a time of fiscal crisis statewide.

A triumphant Jones, the Assembly judiciary chairman, greeted the news of his bill's passage Monday afternoon by thanking the governor for signing the bill despite estimates by his staff that the bill would cost up to $900,000 a year.

"These hearings are deciding the very futures of these children," said Jones. "It makes no sense whatsoever to deny them the opportunity to be there and participate. The costs of not doing so are enormous in terms of bad decisions about placements, further abuse and neglect, and broken lives."

Jones said he was moved to act after reading in the Mercury News the story of former foster youth-turned-student activist Zairon Frazier of Alameda County.

Frazier fought to attend all his court hearings but did so by his own sheer will and determination. Absent support, he traveled by bus and train to and from his court hearings, at times in the dark, alone and afraid. When he left the foster care system at age 18, his final "emancipation hearing" was held in his absence. No one bothered to change the date to avoid a scheduling conflict with his high school final exams.

'A duty'

Frazier - now 21 and busy scraping together the money to attend the University of Hawaii by working three jobs - said he is elated to hear the path will be easier for foster youths now coming through the system.

"I did not know the entire state senate would be voting on a story about what happened to me in foster care. I consider it an honor, it's very exciting," he said. "But I also consider it a duty. I'm a foster youth advocate, it's what I'm supposed to do. If something went wrong with you, change it so that it won't happen to anybody else."

Last week, Schwarzenegger signed two other bills to improve the foster care system. One bill requires county welfare departments to provide youths aging out of the system with documents needed to obtain medical benefits and other social services, as well as family photographs and information regarding Indian heritage. A second bill strengthens the legal rights of foster youth who have children of their own while in the system.
